Returned Goods Relief: Bringing Exports Back Without Paying Duty Twice
The shipment came back, and so did the duty
A Houston distributor imports industrial routers from Shenzhen, pays the duty, and sells $85,000 worth to a customer in Monterrey. Fourteen months later the customer rejects the batch over a firmware issue and trucks it back across the border. The broker files a standard consumption entry. The routers pay duty a second time, including the additional tariffs that now apply to Chinese-origin goods, on equipment that has already cleared US customs once.
It did not have to happen. The United States, the United Kingdom and India all have a relief for goods that leave and come back unchanged. The rules look similar on paper — a time limit, an unchanged condition, proof of export — but the details differ in ways that decide whether the relief holds up at audit.
Three regimes side by side
| Point | United States | United Kingdom | India |
|---|---|---|---|
| Legal basis | HTSUS 9801.00.10, 19 CFR 10.1 | Returned Goods Relief, HMRC Notice 236 | Notification 45/2017-Customs |
| Time limit | None for US goods; 3 years for foreign goods | 3 years from export | 3 years, extendable by 2; 1 year for scheme exports |
| Condition | Not advanced in value or improved | Unaltered, apart from maintenance | Same goods; repairs taxed on repair cost |
| Import VAT / IGST | No federal VAT | Relieved only if same person re-imports | IGST refunded at export must be paid back |
| Export incentives | Drawback claimed bars relief in most cases | Agricultural refunds shorten or bar relief | Drawback and scheme benefits repaid |
United States: 9801 since TFTEA
HTSUS 9801.00.10 has long covered US-made goods returned without having been advanced in value or improved in condition abroad. The Trade Facilitation and Trade Enforcement Act of 2015 widened it: foreign-origin goods now qualify too, if they come back within three years of export. That change is what would have saved the Houston distributor.
The paperwork is where claims fail. Under 19 CFR 10.1, CBP may ask for a declaration by the foreign shipper that the goods were not improved abroad, and a declaration by the importer, owner or agent with knowledge of the facts. CBP guidance indicates these documents may be requested for shipments valued over $2,500, and unmarked goods above that value may need a manufacturer's statement as well. The importer carries the burden of proof; an unsupported claim can lead to a rate advance and recordkeeping penalties. If the goods were repaired or altered abroad, the right provision is 9802, which taxes only the value of the work, as explained in our guide to outward processing and HTSUS 9802.
United Kingdom: Returned Goods Relief
HMRC Notice 236 sets the UK conditions. The goods must have been in free circulation when exported, must come back within three years, and must be unaltered apart from work needed to keep them in working order. Partial returns qualify for the part that comes back. Relief from import VAT adds one more condition: the person re-importing must be the person who exported. Group structures trip on this regularly — a returns hub run by a different entity than the exporting company keeps the duty relief but loses the VAT relief.
As in the US, the relief follows customs status rather than origin. Garments made in Vietnam, cleared into the UK, sold to American customers and returned, are eligible. This matters because the UK–Vietnam trade agreement would not apply on the way back without fresh origin proof.
India: Notification 45/2017
India's relief works differently: it exempts re-imported goods from duty in excess of the export benefits availed. In practice, the exporter pays back what it received when the goods left: duty drawback, IGST refunded on zero-rated exports, or benefits under export schemes. The general window is three years, extendable by up to two more years by the Commissioner for sufficient cause; for goods exported under Advance Authorisation, DFIA or EPCG it is one year, extendable by one. Goods repaired abroad pay duty on the fair cost of repairs, insurance and freight. Identity is checked closely — CESTAT has rejected claims where re-imported goods were mixed into general stock and could not be traced to a specific shipping bill. If you claimed drawback at export, our duty drawback guide explains what has to be reversed.
Three worked examples
Duty rates below are working assumptions for illustration; check the current tariff for your exact code.
Example 1 — the routers back from Monterrey (US). Value $85,000, returned 14 months after export. Assume a combined rate of 25% once base duty and additional China tariffs are added: $21,250 on a standard entry. Under 9801.00.10, nothing — as long as the foreign shipper's declaration, the importer's declaration, the original entry and the export record are on file.
Example 2 — monthly customer returns (UK). A Manchester apparel brand consolidates returns from US customers into one shipment worth about £24,000 a month, roughly 1,300 lb of garments. At 12% duty, a common UK Global Tariff rate for knitted garments (assumption), that is £2,880 a month, over £34,000 a year, plus £5,376 of import VAT. With RGR claimed and the brand itself as importer, both disappear.
Example 3 — the rejected knitwear (India). A Tiruppur exporter ships knitwear worth ₹48 lakh FOB; the UK buyer rejects it and it returns five months later. At export, the company claimed drawback of ₹96,000 (an assumed 2% rate) and an IGST refund of ₹2.4 lakh at 5%. Under Notification 45/2017 it repays both — and the IGST paid on re-import is normally creditable. Without the notification, basic customs duty at an assumed 20%, plus the 10% social welfare surcharge on that duty, would reach about ₹10.6 lakh before IGST.

Run the calculation →One habit covers most of the risk: when goods leave and might come back — demo units, tooling sent to a contract manufacturer, consignment stock — record serial numbers, keep the export filing reference, and tell your broker before the return lands. A mould shipped to an overseas supplier is a special case worth planning: its value already enters the duty on every batch of parts, as our article on assists in customs value shows, and it can easily outstay a three-year window.
Frequently asked questions
Can foreign-made goods qualify for US returned goods treatment?+
Yes, since the Trade Facilitation and Trade Enforcement Act of 2015 (signed February 2016). HTSUS 9801.00.10 covers US-origin goods returned at any time and foreign-origin goods returned within three years of export, provided they were not advanced in value or improved in condition abroad. Before TFTEA, a Chinese-made product exported from the US and sent back paid duty again.
What paperwork does CBP ask for under 9801.00.10?+
Under 19 CFR 10.1, a declaration by the foreign shipper that the goods were not advanced in value or improved abroad, and a declaration by the importer or owner supporting the claim. CBP guidance indicates these may be requested for shipments valued over $2,500. Keep proof of export (the EEI filing or bill of lading) and, for foreign goods, the original import entry.
Does UK Returned Goods Relief cover import VAT?+
It can, but only if the person re-importing the goods is the person who exported them, and any VAT due on them was paid (HMRC Notice 236). Duty relief does not require the same person; VAT relief does. If a UK subsidiary re-imports what its parent exported, expect to account for import VAT, usually through postponed VAT accounting.
What if the goods were repaired abroad before coming back?+
Then returned goods relief generally does not apply, because the goods are no longer in the same state. In the US, HTSUS 9802.00.40 and 9802.00.50 tax only the cost of the repair or alteration. In the UK, outward processing does the same if it was authorised before export. In India, Notification 45/2017 charges duty on the fair cost of repairs, insurance and freight.
Do I have to repay export incentives when goods come back to India?+
Yes. Notification 45/2017-Customs grants relief from duty in excess of the export benefits availed: drawback, IGST refunds and scheme benefits must be paid back or reversed. Goods exported under Advance Authorisation, DFIA or EPCG have a shorter window, typically one year, extendable by one more year.
