Tariff-rate quotas: the counter that decides your duty rate

Same cargo, two duty bills — one number apart

A US refiner imports 100 tonnes of raw cane sugar. If the shipment is entered while the tariff-rate quota is open, the duty is roughly $1,460. If it is entered a week after the quota fills, the same cargo owes roughly $33,870. Same product, same supplier, same declared value. The only variable is a counter.

That counter is a tariff-rate quota — a defined volume that may enter at a low or zero rate during a defined period, after which the ordinary rate resumes. It is neither a permanent exemption nor an import ban. It is a queue, and your position in that queue is set by the date your entry is filed.

This guide covers how the mechanism is administered in the US, UK, EU and India, where the operational traps sit, and how to price both outcomes before committing to a purchase order.

TRQ, absolute quota, and duty suspension are not the same thing

Three instruments get used interchangeably in conversation and produce completely different outcomes at the border.

  • A tariff-rate quota caps a rate advantage. Above the volume you still import freely, at the higher rate.
  • An absolute quota caps the quantity. Above the volume the goods cannot be entered for consumption at all in that period, no matter what duty you offer to pay. These are rare and tightly disciplined under WTO rules.
  • A duty suspension removes the rate with no volume ceiling, for a fixed term, typically on industrial inputs not made domestically.

The multilateral foundation is the WTO Agreement on Agriculture from the Uruguay Round: converting old non-tariff barriers into tariffs left a residue of volumes admitted at concessional rates. GATT Article XIII additionally requires that the allocation among supplying countries be non-discriminatory. More than a thousand such volumes are notified at the WTO today, overwhelmingly agricultural.

How the major markets allocate the volume

United States. Quota-controlled goods are flagged in the tariff schedule and administered by CBP, which announces the opening date and time of each quota period. Everything presented at the opening instant is deemed simultaneous; if presentations exceed the volume, CBP prorates. Sugar, certain dairy lines, beef, cotton and tobacco are the classic examples. The US WTO minimum access commitment for sugar sits at roughly 1.12 million tonnes raw value across raw and refined lines. Section 232 steel and aluminium measures have separately used country arrangements structured as volume caps; that programme has been tightened repeatedly since 2018 and again in 2025, so verify the rate and the arrangement in force for the quarter you are shipping in.

United Kingdom. Quotas under the UK Global Tariff are shown directly in the online tariff with a live balance, and most are first-come-first-served against the date the declaration is accepted. The UK steel safeguard, inherited at the point of EU exit and reviewed by the Trade Remedies Authority, runs on country-specific and residual volumes with a 25% over-quota duty — the mechanism that most often surprises UK buyers of rebar and hot-rolled coil.

European Union. Most volumes are first-come-first-served against a six-digit order number beginning with 09, allocated centrally on a daily cycle by reference to the date the declaration was accepted. Once about 90% of the initial volume has been drawn, the quota is flagged critical and release at the reduced rate requires a guarantee covering the spread.

India. TRQs opened under trade agreements — the gold volume under the India-UAE CEPA is the most cited, reported at 200 tonnes a year with a one-point duty concession — are allocated administratively by the DGFT to eligible entities ahead of shipment, not at the border. Getting the allocation is a licensing exercise; the customs entry merely uses it.

What the spread actually looks like

Three worked examples

Example 1 — 100 t of raw cane sugar into the US

Quantity = 100,000 kg (about 220,460 lb)

In-quota: 100,000 × $0.014606 = $1,460.60

Over-quota: 100,000 × $0.3387 = $33,870.00

Spread on one shipment = $32,409.40

This is why sugar entries are filed at the opening minute and why bonded storage between quota periods is routine in the trade. The specific rates are duty per unit of weight, so the spread scales with tonnage and is completely independent of the price you negotiated.

Example 2 — 500 t of rebar into the UK

Customs value = GBP 400,000

Within the safeguard volume: 0% → GBP 0

Outside it: 400,000 × 25% = GBP 100,000

Anti-dumping duty, if applicable to the origin, stacks on top

On a distribution margin of 10-12%, an over-quota entry turns the trade loss-making outright. The volumes reset each quarter, so a shipment that misses the window by four days can sometimes be held and entered on the first working day of the next quarter — provided the demurrage clock does not eat the saving.

Example 3 — an industrial input under an EU autonomous quota

40 t of a compound not produced in the EU, value EUR 85,000

MFN at 6.5% → EUR 5,525

Under the autonomous volume at 0% → EUR 0

Cost of omitting the order number on one entry = EUR 5,525

The benefit is claimed, never granted automatically. If the order number is missing from the declaration, the full rate is assessed and recovery depends on a refund claim whose outcome turns on the balance available on the original acceptance date. Putting the number on the product master record is a five-minute control with a four-figure annual return.

A four-step playbook

  1. Price both outcomes at quotation stage. Fill rate plus transit time tells you which rate you will realistically pay.
  2. Secure the origin proof before departure. A preferential volume opens only against a valid proof; a challenged certificate retroactively pushes the consignment to the full rate.
  3. Decide the bonded-storage fallback in advance. Know your carrying cost per day per container so the wait-versus-pay decision takes minutes, not a week.
  4. Check the guarantee line. Once a quota is critical, release at the reduced rate needs security for the spread.

A rate is not a property of the product — it is a property of the date

Under a quota regime, asking "what is the duty on this HS code" is only half the question. The complete question is "what is the duty on this code, from this origin, on the date my entry will be accepted, given today's fill rate". Importers who track the counter arbitrage their order dates; importers who do not discover the answer on the duty bill.

Frequently asked questions

How do I find out whether my product has a tariff-rate quota before I place the order?+

Check the tariff schedule of the destination market against your classification and country of origin. In the US, quota-controlled goods carry a subheading in HTSUS chapter 99 alongside the chapter 1-97 line, and CBP publishes quota bulletins with opening dates and fill status. In the EU, the TARIC database returns a six-digit order number starting with 09 plus a daily balance. In the UK, the online tariff shows the quota volume and the remaining balance. Do this at the quotation stage: if the quota is already 85% filled and your transit time is five weeks, you should be pricing the out-of-quota rate, not the preferential one.

What exactly is "quota priority" in the US and why does the timing matter so much?+

For quota-controlled merchandise, CBP opens the quota period at a specified date and time across all ports simultaneously. Entries presented at the opening moment are treated as filed at that instant; if the volume presented exceeds what is available, CBP prorates the allocation among them. That is why customs brokers stage documentation days in advance and file at the exact opening minute for tight quotas. Merchandise arriving after the quota fills is not rejected — it simply enters at the higher over-quota rate, or the importer warehouses it and waits for the next period.

Can I put the goods in a bonded warehouse and wait for the quota to reopen?+

Yes, and this is the standard mitigation. Because duty liability is generally determined when the goods are entered for consumption rather than when they physically arrive, storing the consignment under a warehousing or free-zone regime lets you defer the entry to the next quota period. Weigh it against the carrying cost: storage, insurance, financing and any container demurrage can easily exceed the duty saved on a low-value cargo. The arbitrage works best where the spread between the in-quota and over-quota rate is wide, which is typically the case in agriculture.

Does a quota exemption follow the seller or the origin of the goods?+

It follows the non-preferential origin of the goods. Country-specific quota allocations are charged against the origin country regardless of where the shipment was consolidated, invoiced or transshipped. Re-invoicing through a trading company in a third country changes nothing, and simple repacking does not confer new origin. Only substantial transformation under the applicable origin rules moves the goods to a different quota line, and customs authorities examine those claims closely, because quota circumvention is a standard post-clearance audit target.

Do anti-dumping duties still apply inside a tariff quota?+

Usually yes, unless the measure explicitly provides otherwise. A tariff quota governs the ordinary duty rate; trade-defence duties are a separate layer with their own scope and their own rates. It is entirely possible to import inside a safeguard quota at 0% ordinary duty while still paying an anti-dumping duty of 20% or more on the same consignment. Always price the two layers separately, and check whether the trade-defence measure itself contains an undertaking or a volume-based exemption.
